  1. Who we are

This Privacy Policy applies to LTC Shed Constructions Pty Ltd (ABN 45 673 779 514, ACN 673 779 514), referred to as “LTC”, “we”, “us” or “our”. We are a family owned shed construction business working out of Emerald, Queensland, building sheds across central Queensland and beyond.

This policy explains how we collect, hold, use and disclose personal information, and how you can contact us about it. It applies to our website at ltcshedconstructions.com.au, to enquiries you make with us by phone, email, social media or in person, and to the information we handle when we quote for and carry out your project.

We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth). If this policy and the Privacy Act ever differ, the Privacy Act applies.

2. What personal information we collect

Personal information is information about you as an identifiable individual. The kinds we collect depend on how you deal with us.

When you enquire or ask for a quote, we collect:

  • your name
  • your phone number
  • your email address
  • the town or suburb where the shed will be built
  • the type of shed you are interested in
  • whether you think you will need council approval or a concrete base
  • anything you tell us in your message

When we quote for and carry out your project, we may also collect:

  • the address of the site
  • details about the site, the block, access and existing structures
  • plans, drawings, photographs and measurements of the site and the shed
  • details of any shed kit you have bought from another supplier
  • your council approval, engineering, certification and insurance documents where they relate to the job
  • payment details such as your bank account name and transaction records. We do not store credit card numbers.
  • records of our communications with you

When you visit our website, our systems automatically collect technical information such as:

  • your IP address
  • the type of device, browser and operating system you use
  • the pages you visit, how long you stay and the site that referred you
  • the date and time of your visit

We do not ask for sensitive information such as health information, religious beliefs or criminal records. If you give us sensitive information, for example in a message, we will only use it for the purpose you gave it to us.

If you apply to work with us, we collect the information in your application, your resume and your references. We will deal with that information in line with this policy and the Privacy Act.

3. How we collect personal information

We collect personal information directly from you when you:

  • fill in the enquiry form on our website
  • call, email or message us, including through Facebook or Instagram
  • meet with us on site or at your property
  • sign a quote or contract with us
  • leave a review or give us a testimonial

We collect technical information automatically when you use our website, through our web server logs, Google Analytics and Google reCAPTCHA. See section 7.

Sometimes we receive personal information about you from other people, for example a family member who makes the first enquiry on your behalf, an engineer or certifier working on your project, a shed manufacturer whose kit you have bought, or your local council. If that happens we will handle the information in line with this policy.

You can deal with us anonymously or under a pseudonym for general questions, but we cannot quote for or build a shed without knowing who you are and where the site is.

4. Why we collect, use and disclose personal information

We collect, hold, use and disclose personal information so we can:

  • answer your enquiry and prepare a quote
  • plan, price, schedule and carry out your project
  • communicate with you about your project, including progress, variations and payments
  • arrange the trades and suppliers involved in your project
  • apply for or assist you with council approvals, engineering and certification where that is part of the job
  • issue invoices and receipts, and keep the records the law requires us to keep
  • respond to questions, complaints or disputes
  • meet our obligations under the Queensland Building and Construction Commission Act 1991, the Australian Consumer Law, tax law and other laws
  • improve our website and services
  • send you marketing about our services, but only with your consent. See section 8.

We will only use or disclose your personal information for the purpose we collected it, for a related purpose you would reasonably expect, with your consent, or where the law requires or permits it.

5. Who we share personal information with

We do not sell personal information. We share it only where we need to in order to run the business and do your job. Depending on your project, that may include:

  • the builders, concreters, electricians, plumbers, earthworks operators and other trades who work on your project with us
  • shed manufacturers and suppliers, so they can supply, design or engineer the shed
  • engineers, building certifiers and surveyors
  • your local council, the QBCC or other authorities where an approval, licence or notification is required
  • our accountant, bookkeeper, insurer and, if needed, our lawyer
  • the service providers who run our website, email, forms and IT systems. See section 6.
  • anyone you ask us to share information with
  • government agencies, courts or regulators where the law requires us to

We only share what is needed for the purpose, and we expect the people we share it with to protect it.

6. Service providers and overseas disclosure

We use a small number of third party providers to run the business. Some of them store data outside Australia.

  • Website hosting: our website is hosted with Digital Pacific on servers located in Australia.
  • Enquiry form: enquiries submitted through our website are stored in our website database in Australia and emailed to us.
  • Email and files: we use Microsoft 365 for email and documents. Google: we use Google Analytics, Google reCAPTCHA, Google Search Console and Google Business Profile. Google is based in the United States and may store and process data in the United States and other countries where Google operates.
  • Social media: if you contact us through Facebook or Instagram, Meta Platforms handles that message under its own privacy policy and may store it outside Australia.

Where we disclose personal information overseas we take reasonable steps to make sure the recipient handles it in a way that is consistent with the Australian Privacy Principles, mainly by using established providers with their own privacy and security commitments. We do not otherwise send personal information overseas.

7. Cookies, analytics and reCAPTCHA

Cookies are small files that a website places on your device. Our website uses:

  • Google Analytics cookies, which help us understand how people use the site, for example which pages are visited and how visitors arrive. Google Analytics collects your IP address, device and browser details and the pages you view. Google Analytics 4 does not log or store your full IP address, and we do not use it to identify you personally. You can stop Google Analytics collecting data by installing Google’s browser add-on for opting out of Google Analytics, or by blocking cookies in your browser.
  • Google reCAPTCHA, which we use on our enquiry form to tell people from automated spam. reCAPTCHA sets a cookie and analyses information about your device, browser and how you interact with the page, and sends that information to Google. Google processes this information on our behalf and on our instructions only, and we are responsible for it. reCAPTCHA is used only to protect the form from misuse.
  • Functional cookies set by our website software (WordPress) so that the site works properly. These do not identify you.

We do not use cookies to serve advertising and we do not run any advertising networks on our website.

You can set your browser to refuse cookies or to warn you when a cookie is being sent. Some parts of the website may not work properly if you do.

8. Direct marketing

We do not send marketing emails or text messages unless you have agreed to receive them, for example by ticking a box or telling us you would like to hear from us. 

If you receive marketing from us, every message will identify us and tell you how to unsubscribe, and you can opt out at any time by using the unsubscribe link, replying STOP to a text, or contacting us using the details in section 13. We will act on your request promptly.

We comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).

9. How we store and protect personal information

We hold personal information in our website database, in our Microsoft 365 email and file storage, in our accounting software, and in paper files where needed.

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These steps include using a secure (https) website, keeping our website software up to date, running a security plugin and firewall on our website, keeping regular backups of the website, protecting our accounts with strong passwords, and limiting access to the people who need it.

No method of transmitting or storing information is completely secure. If you are concerned about sending sensitive information through our website, you are welcome to call us instead.

10. How long we keep personal information

We keep personal information for as long as we need it for the purpose we collected it, and then for as long as the law requires. Building, contract, tax and insurance records are typically kept for at least seven years after the project is completed, because Queensland building law, tax law and our insurance require it.

Enquiries that do not lead to a job are kept for a shorter period so we can follow up if you come back to us. When we no longer need personal information and are no longer required to keep it, we take reasonable steps to delete it or de-identify it.

11. Accessing and correcting your personal information

You can ask us for a copy of the personal information we hold about you, and you can ask us to correct it if it is inaccurate, out of date, incomplete or misleading. Contact us using the details in section 13.

We will respond within 30 days. We may need to verify your identity before we give you access. We do not charge for access, but if a request is large or complex we may charge a reasonable fee to cover our costs and we will tell you before we do. If we refuse access or correction we will tell you why in writing, and you can complain about our decision as set out in section 12.

12. Complaints and data breaches

If you have a question or complaint about how we have handled your personal information, contact us using the details in section 13. Please give us as much detail as you can. We will acknowledge your complaint within seven days, look into it, and give you a written response within 30 days. If we need more time we will tell you.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

If personal information we hold is lost or accessed or disclosed without authorisation, we will assess the incident and, where required by the Notifiable Data Breaches scheme in the Privacy Act, notify the affected people and the Office of the Australian Information Commissioner.

Our website may link to other websites, including Facebook, Instagram and the websites of shed manufacturers and authorities. We are not responsible for the privacy practices of those websites. Read their privacy policies before giving them your information.

15. Changes to this policy

We may update this policy from time to time, for example when we add a new tool to our website or change how we handle information. The current version will always be on our website with the date it was last updated. If we make a significant change we will make that clear on the page.
