1. About these terms
This website at ltcshedconstructions.com.au (the “website”) is owned and operated by LTC Shed Constructions Pty Ltd (ABN 45 673 779 514, ACN 673 779 514), referred to as “LTC”, “we”, “us” or “our”.
By using the website you agree to these Terms and Conditions, our Privacy Policy and our Website Disclaimer. If you do not agree, please do not use the website.
These terms apply to the website only. They are not the terms of any contract for building work. See section 4.
2. Our licence
LTC Shed Constructions Pty Ltd is licensed under the Queensland Building and Construction Commission Act 1991. QBCC licence number 15515419. You can check our licence on the QBCC register at qbcc.qld.gov.au.
3. Information on the website is general
The website gives general information about who we are, the kinds of sheds we build and where we build them. It is provided to help you decide whether to contact us. It is not a quote, a recommendation for your particular site, or engineering, building, planning or legal advice.
Every shed depends on the site, the soil, the wind region, the intended use, the local council’s requirements and your budget. Nothing on the website replaces a site visit, a written quote, engineering and the approvals your project needs.
We try to keep the website accurate and up to date, but we do not promise that everything on it is complete, current or free of errors. Prices, services, service areas and availability can change without notice.
4. Quotes, contracts and building work
Sending an enquiry through the website, and our reply to it, does not create a contract. No contract for building work is formed through the website.
Any quote we give you is an estimate based on the information available at the time. Unless the quote says otherwise it is valid for 30 days and may change if the site, the design, the materials, the approvals or the scope change. Prices we publish or quote include GST unless we say otherwise.
All building work is carried out under a separate written contract signed by both parties. Where the work is domestic building work, that contract complies with Schedule 1B of the Queensland Building and Construction Commission Act 1991, and we will give you everything that Act requires before you sign. The terms of that contract, not these website terms, govern the building work.
Unless our written contract says otherwise:
- you are responsible for obtaining any council or planning approvals, or for engaging us to do so as part of the contract
- you are responsible for confirming boundaries, easements and underground services on your property, and for site access
- any shed kit, product or material you supply yourself is your responsibility as to its quality, suitability and completeness, and we build to the manufacturer’s specifications and engineering for that product
- concrete slabs, earthworks, electrical and plumbing work are separate items and are only included if the contract says so
5. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For services these include that they will be provided with due care and skill, will be fit for any purpose you make known to us, and will be supplied within a reasonable time. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
6. Intellectual property
The content of the website, including text, photographs, logos, icons, graphics, layout and design, is owned by or licensed to LTC and is protected by copyright law. You may view and print pages for your own personal, non-commercial use. You must not copy, reproduce, publish, distribute, modify or use any part of the website for commercial purposes without our written permission.
We use LTC Shed Constructions and “Any shed, any size, anywhere” as trade marks in connection with our business. Other brand names on the website belong to their owners.
7. Acceptable use
You agree not to:
- use the website for any unlawful purpose
- submit false or misleading information through our enquiry form
- use automated tools to scrape, harvest or send information to the website
- introduce viruses or malicious code, or try to gain unauthorised access to the website or its systems
- do anything that damages, disables or interferes with the website
We may block access to the website by anyone who breaches these terms.
8. Reviews and testimonials
Reviews and testimonials on the website are the genuine opinions of customers, published with their permission. They reflect that customer’s experience and are not a guarantee of the outcome of your project.
9. Links to other websites
The website may contain links to websites operated by other people, including shed manufacturers, authorities and social media platforms. Those links are provided for convenience. We do not control those websites and we are not responsible for their content, accuracy or privacy practices. A link is not an endorsement.
10. Liability
To the extent permitted by law, we are not liable for any loss or damage of any kind, including indirect or consequential loss, that arises from your use of or reliance on the website or its content, or from any interruption, error or unavailability of the website.
Where a law such as the Australian Consumer Law implies a guarantee, condition or warranty that cannot be excluded, and where it is lawful to do so, our liability for a breach of that guarantee in relation to services that are not of a kind ordinarily acquired for personal, domestic or household use is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
Nothing in this section limits our liability under a written building contract with you, which is governed by that contract and by law.
11. If something goes wrong
If you are unhappy with our work or with how we have dealt with you, tell us first. Call 0456 869 600 or email admin@ltcshedconstructions.com and we will do our best to sort it out.
If we cannot resolve it between us, the QBCC offers a free early dispute resolution service for building work disputes. You can contact them at qbcc.qld.gov.au or on 139 333. Nothing in these terms affects your right to go to the QBCC, to QCAT or to a court.
12. Privacy
We collect and handle personal information in line with our Privacy Policy, which forms part of these terms.
13. Changes to the website and these terms
We may change the website or these terms. A change takes effect when it is published here, and the date at the top of this page shows when these terms were last updated. If we make a significant change we will make that clear on the page. If you do not agree with a change, please stop using the website.
14. General
If any part of these terms is invalid or unenforceable, the rest of the terms continue to apply. If we do not enforce a right under these terms, that does not mean we have waived it.
15. Governing law
These terms are governed by the laws of Queensland, Australia. You agree to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
